GENERAL CONDITIONS OF USE AND RENTAL
Introduction
This document contains the general conditions applicable to the rental services of properties acquired from VILLAS AND YOU for accommodation both in properties managed exclusively by the company and in others in which it is limited to providing support services to the owners who offer their services. properties as holiday accommodation.
The general booking conditions, detailed below, form an integral part of the contract between the guest and the owner of the rented property who assume all responsibility in this agreement. VILLAS AND YOU acts only as an intermediary. Therefore, by signing this agreement, you accept these conditions in full, regardless of the means you use to make your reservation.
2. Rates
The published rates for our rental portfolio of villas, houses and apartments will always be expressed as daily rates.
3. Reservation and payment conditions
3.1. Object of the contract
The reservation and the contract are for tourist purposes only, not for commercial purposes, events, advertising activities or any other type. Therefore, we decline all responsibility towards companies or individuals for any damages suffered, such as loss of income or any activity that is not for tourist purposes.
3.2. Reservation methods
Reservations can be made by phone, email or through the website www.villasandyou.com. However, reservations only become binding when VILLAS AND YOU receives the initial payment on account from the occupant.
3.3. Way to pay
Payments can be made by bank transfer or bank card.
3.4. Price
Prices will be as advertised on the website plus any additional mandatory or optional fees and are subject to change at any time.
If the reservation is made through a third-party website or tour operator such as Airbnb, Booking or similar, the guest will be required to pay their fees and commissions in addition to the price advertised on our official website.
3.5. Payment plans
Payment plans will be as indicated on the website (partial or full payment will be required depending on when the reservation is made in relation to the arrival date)
3.7. Payment terms
The payment conditions will be indicated in the reservation confirmation and in no case will the delivery of keys be possible without VILLAS AND YOU having received the full amount of the reservation.
3.8. Reservation cancellation due to non-compliance with payment conditions
Once more than 7 days have passed from the payment deadline, the reservation will be automatically canceled without any refund.
3.9. Extend your stay
This request is subject to availability, please ask VILLAS AND YOU.
3.10. Shorten your stay
If you decide to shorten your stay for any reason, you will not be entitled to any type of refund.
3.11. Occupier's request to change ownership
Change of ownership is not allowed on a confirmed booking because all properties are privately owned by different individual owners.
3.12. Occupant request to change dates
This request is subject to availability and approval by the property owner, therefore we reserve the right to reject this request, please ask VILLAS AND YOU.
3.13. No-show
If after forty-eight (48) hours from the beginning of the stay, you do not show up at our offices or do not show up on the date on which you have informed us of your arrival, the reservation will be deemed canceled and you will not have the right to discount or refund on the total price of the reservation.
4. Cancellation conditions
Guests who have booked through an agency or tour operator must respect the cancellation conditions specified by said intermediary, unless VILLAS AND YOU decides otherwise.
If the reservation has been made directly with VILLAS AND YOU, payments made to reserve are non-refundable.
We advise all guests to purchase travel insurance through their insurer to cover them in the event of cancellation.
5. Travel insurance
The guest is responsible for insuring their stay, the rental does not include guest insurance and neither VILLAS AND YOU nor the property owner is responsible for any insurance related issues before, during or after your stay.
6. Security deposit
The reservation includes a deposit to guarantee the correct use and care of the furniture, equipment and respect for the conditions of use and departure. This amount must be paid before arrival by guests by bank card or bank transfer.
The security deposit will be released or refunded 14 days after the end of the stay,
provided that the accommodation is not damaged and the guest has complied with all the conditions of use and rental.
7. Specific conditions for long-term reservations
Long-term reservations are those announced in the 'Long Term' section of our website and whose cost has been established according to the monthly rates indicated on our website.
7.1. Price of long-term reservations
Guests who have booked through an agency or tour operator must comply with the conditions specified by that intermediary.
Published monthly rental rates for long-term stays may vary depending on the month chosen. No discounts available. These rates do not include electricity, water, gas or diesel costs. Guests are responsible for these costs which will be based on actual consumption and the cost indicated on invoices received for the period of stay.
7.2. Security deposit for long term reservations
For long-term reservations, the amount of the deposit is established depending on the number of months reserved and the specific property, it is usually one or two months' rent.
This amount must be paid by bank transfer at the time indicated in your contract or reservation confirmation, and will be returned to you once your stay in the accommodation has ended within a period of between 30 and 60 days, once we have checked the condition of the property. and deducting the amounts corresponding to the energy supply bills that could be outstanding and as long as all the conditions of use and rental have been met. The security deposit will not be returned until said invoices are in the possession of VILLAS AND YOU.
8. Arrival at the property
Check-in will generally be after 16:00 p.m. in our office / access point.
For arrivals outside of office hours, keys can be collected from a coded lockbox located outside our office/access point.
Once the guest has completed online check-in (passport/ID registration) and paid the corresponding security deposit at least 14 days before arrival, detailed instructions regarding their arrival and how to collect the keys will be sent.
9. Leaving the property
You must vacate the property before 10:00 am and must return the set of keys or leave it at the location indicated by VILLAS AND YOU. If you have not left the property within the indicated time, VILLAS AND YOU may apply an extra charge of up to 1 day's rental, as this delay seriously affects our cleaning and quality control procedures.
If any serious damage is identified or valuable items are discovered to be missing from the property after your departure, you will be charged to cover the cost of this damage, your card will be charged to compensate for failure to meet contractual obligations. If the damage you have caused is not covered by the security deposit, you will be notified by email or phone. If we cannot reach an agreement, we will take steps to recover the cost through the relevant legal channels, as defined in Clause 14.
10. Conditions of use
10.1. Guest Responsibility
When you reserve accommodation for other occupants (other than yourself), you are responsible for the full rental price and for any damage caused by your behavior and the behavior of everyone else occupying the rented accommodation. However, legal responsibility falls on all the occupants of the villa, from whom all damages caused by the group can be claimed regardless of who actually caused said damages.
10.2. Maximum number of occupants
The reservation is valid for the maximum number of occupants indicated on the reservation form and in the contract. Use of the accommodation by more than the specified number of occupants is not permitted. If you exceed the maximum number of occupants, the rental agreement may be terminated and you will lose your security deposit. In this case, any payments you have made will not be refunded and you will be responsible for paying the full cost of the rental.
10.3. celebrations or parties
Celebrations and parties are strictly prohibited. Failure to comply with this clause will result in the total cancellation of the reservation without the right to a refund of the price paid. Rental of villas by companies to organize celebrations or parties for third parties is not permitted, regardless of the number of guests attending.
10.4. Smoking prohibited inside the property
Smoking is only allowed outside the property.
10.5. Pets
To accommodate pets at one of our properties, guests must first ensure that the property they have chosen is pet-friendly. Please ask VILLAS AND YOU.
Each pet must be included in the reservation and costs 50€ each. In the event that VILLAS AND YOU or its suppliers verify that the guest has brought one or more pets during the stay without including them in their reservation and without them being allowed in the property, VILLAS AND YOU is authorized to proceed with the automatic cancellation of the stay, and the guest must vacate the property within EIGHT (8) hours. In the case of villas where pets are allowed, VILLAS AND YOU will not require you to vacate the property, however, you may be charged a penalty of up to three times the established pet rate.
10.6. Access to property
During your stay, the accommodation is exclusively for your use. However, you are obliged to provide access to the VILLAS AND YOU staff or any of its suppliers during your stay to verify compliance with their obligations described herein, to clean the pool and maintain order and to carry out any repairs or carry out other tasks arising from incidents that occurred on the property during your stay.
10.7. Threats or reasonable doubts about serious property damage
VILLAS AND YOU reserves the right to cancel or cancel the rental if there are threats or reasonable suspicions that it will cause serious damage to the property. If you breach these conditions of use and/or the departure conditions, we will automatically cancel the reservation and you will lose your security deposit.
10.8. Energy
The cost of electricity consumption is included in the rent of our properties, and the rate is set based on a reasonable maximum daily consumption. All occupants are urged to make responsible and reasonable use of heating, air conditioning and energy equipment in general. We remind you of the importance of turning off the lights and especially the air conditioning when the villa is not occupied. Excessive consumption may be charged to the guest and will be deducted from the security deposit.
10.9. Cleaning costs
End-of-stay cleaning costs are included in the reservation price (mandatory additional charge) and are governed by the provisions of clause VIII of the general conditions.
10.10. property keys
You will be given a full set of keys to the property upon arrival.
11. Changes in reservations or cancellation by VILLAS AND YOU due to unforeseen circumstances
VILLAS AND YOU reserves the right to replace the reserved accommodation with a similar one in the event of a serious unforeseen event that makes it impossible to stay in the reserved accommodation. If it is not possible to accommodate you in a similar property or the proposed accommodation is not to your liking, you will be offered alternative dates or your reservation will be canceled and the full amount you have paid will be refunded without any additional compensation. .
12. Benefits and responsibilities
With the exception of typographical errors, the information describing the accommodation offered is provided in good faith based on inspections of the properties and statements of the owners. VILLAS AND YOU undertakes to ensure that the accommodation is as described in its general conditions, although it understands and accepts that specific changes may occur in the contents as a result of its habitual use, such as different appliances, outdoor furniture or elements. of decoration, which are replaced periodically.
VILLAS AND YOU declines all responsibility for any modification that affects the accommodation or its surroundings and that is not under the direct control of VILLAS AND YOU. You specifically agree that you have no right to claim any compensation for any of the following anomalies that are unforeseeable and cannot be prevented by VILLAS AND YOU.
VILLAS AND YOU will not be responsible for possible errors in the descriptions of the properties made by third-party tour operators or travel agencies.
12.1. Plays
Properties are generally privately owned by several different people and are usually located in large residential areas. Therefore, it may be the case that there are unexpected construction works underway in the surrounding area. This construction work is generally carried out by owners, building contractors or government organizations with which VILLAS AND YOU has no relationship, so VILLAS AND YOU has no control over this work. Therefore, by booking the accommodation, you understand and accept that neither VILLAS AND YOU nor the owners are responsible for any inconvenience caused by works not carried out by the Accommodation Provider.
12.2. Cable/satellite television
If the description indicates that there is satellite or cable television in the property, this does not necessarily mean that it is possible to receive all the channels you would like. The owners, most of whom are foreigners, have decoders that do not necessarily receive all the international channels, but only a selection of these.
12.3. Water, electricity and Internet
In the event of occasional water, electricity and/or internet outages by municipal, regional authorities and/or service providers, the guest assumes that neither VILLAS AND YOU nor the villa owner will have any responsibility for any inconvenience or damage. caused by such limitations.
12.4. Accidents and theft
Neither VILLAS AND YOU nor the owner is responsible for any loss, damage or harm (injuries, illness, death, material damage or theft) suffered by you or your companions during your stay. By booking the accommodation, he accepts that he is responsible for the safety of his own belongings and understands that he cannot hold VILLAS AND YOU or the villa owner responsible for such incidents. To minimize potential risks, it is recommended that you take extra care when using the kitchen and pool areas, which present additional risks to occupants. Please ensure you properly close and lock all doors and windows on the property. These recommendations are especially relevant when there are children and/or elderly people among the occupants.
13. Suggestions and incidents
Our quality and customer service policy, because our accommodation is usually full, some incidents may not have been detected in the accommodation you have booked. Please notify us of any such issues within the first 48 hours of your stay via our email info@villasandyou.com so that we can resolve the issue as quickly as possible, with minimal impact on your stay. If you do not notify us of any problems within the first 48 hours, you will lose the right to claim any defects you detected upon arrival. We need you to notify us of such incidents to ensure that you are not responsible for any breakages or damage caused by previous occupants that were not detected by our team during the pre-arrival inspection.
It is important that you, as an occupant, agree and understand that some incidents arise naturally as a consequence of the wear and tear of the property, and that in some cases they are impossible to foresee (for example, septic tank problems, boiler problems, faucets broken, electrical breakdowns, etc.); Other incidents may be beyond our control (for example, general power outages, construction in the surrounding area, noise from neighbors or animals, insect problems, etc.).
At VILLAS AND YOU we will in any case do everything within our power to resolve or minimize the impact of incidents that occur during your stay. However, by booking your stay you accept that VILLAS AND YOU will be responsible only for matters over which you have control and actual ability to resolve during your stay, and that certain events, especially during high season, may take longer to resolve. than you might want, as they require assistance from specialized providers whose availability is not guaranteed.
We would kindly ask you to help us detect any problems and report them as accurately as possible; Please inform our team politely and constructively, keeping in mind that they are committed to doing everything possible to resolve the issue, but to do so they need your help and respect.
Incidents must be reported by telephone by email to info@villasandyou.com, not through third parties.
It is important to note that VILLAS AND YOU will never offer financial compensation.
14. Validity and contractual term
The contractual relationship is subject to Spanish legislation and to the Courts and Tribunals of Torrevieja (Alicante) for any claims or disputes that may arise between the parties in relation to stays in our accommodation.
15. Data protection
In compliance with Organic Law 15/1999, on the protection of personal data, you are informed that your data will be incorporated into an automated guest file by this company, for the purposes of your commercial relationship and subsequent information, and that your data may be transferred to other third parties in the cases provided for by law, such as financial auditors, competent government agencies for control, registration and inspection purposes and public notaries in the case of elevation to a public document.
Likewise, you are informed that you can exercise your rights of access, rectification, deletion, data portability, limitation of processing or opposition to the processing of your data, as well as withdraw your consent, by writing to VILLAS AND YOU providing a photocopy (both faces) of your ID or, failing that, sending the scanned documentation to the following email address: info@villasandyou.com
